Terms of Use

2.1 User-Uploaded Designs

By uploading designs to our platform, you confirm and warrant that:

• You own the full rights to the image/design OR have obtained proper licensing to use and print the design
• You have permission from any individuals depicted in photographs or artwork
• The design does not infringe on any third-party copyrights, trademarks, or intellectual property rights
• You grant Midnight Arsenal a limited, non-exclusive license to reproduce your design solely for the purpose of fulfilling your order

2.2 Hosting and Storage

We may temporarily store your uploaded designs for order processing purposes. Designs are stored securely and are not shared with third parties except as necessary to fulfill your order. We reserve the right to delete uploaded designs after order completion or account inactivity.

2.3 Print Rights

You must have the legal right to print any image you upload. This includes:

• Original artwork you created
• Designs you have purchased commercial licenses for
• Public domain images
• Images with Creative Commons licenses that permit commercial use

3.1 Prohibited Content

You may NOT upload or request designs that contain:

• Trademark Infringement: Logos, brand names, or designs owned by other companies without authorization
• Hate Speech: Content promoting violence, discrimination, or hatred against any individual or group
• Illegal Content: Drug paraphernalia, weapons promoting violence, or any content illegal under applicable law
• Explicit Content: Pornographic, sexually explicit, or obscene material
• Defamatory Content: False statements that damage someone's reputation
• Counterfeit Goods: Designs intended to imitate or pass off as authentic branded merchandise

3.2 Content Review

We reserve the right to review and reject any design that violates these guidelines. Orders containing prohibited content will be cancelled and refunded minus any processing fees incurred.

4.1 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately if you suspect unauthorized access.

4.2 Login Information

We track last login timestamps for security purposes. You can view your login history in your account settings. We recommend using a strong, unique password for your account.

4.3 Data Export

You have the right to request a copy of your personal data stored on our platform. To request a data export, please contact us at support@midnightarsenal.com. We will provide your data within 30 days of receiving your request.

4.4 Account Deletion

You may request deletion of your account at any time. Upon deletion, your personal information and order history will be permanently removed from our systems, except where retention is required by law.

5.1 Your Rights

• Access to your personal data and order history
• Correction of inaccurate personal information
• Deletion of your account and associated data
• Data portability - receive your data in a common format
• Withdraw consent for marketing communications at any time

5.2 Order Rights

• Receive accurate product descriptions and pricing
• Cancel pre-orders before production begins
• Request refunds according to our refund policy
• Receive tracking information for shipped orders

6.1 Service Availability

While we strive to maintain continuous service availability, we do not guarantee uninterrupted access to our platform. We are not liable for any losses resulting from temporary service outages, scheduled maintenance, or circumstances beyond our control.

6.2 Data Security

We implement industry-standard security measures to protect your data. However, no method of electronic transmission or storage is 100% secure. In the event of a data breach:

• We will notify affected users within 72 hours of discovery
• We will provide information about what data was compromised
• We will take immediate steps to mitigate any damage
• We will cooperate with relevant authorities as required

6.3 Limitation of Liability

To the maximum extent permitted by law, Midnight Arsenal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to:

• Loss of profits, revenue, or data
• Service interruptions or downtime
• Third-party claims related to user-uploaded content
• Errors in product printing or delivery delays

6.4 Indemnification

You agree to indemnify and hold harmless Midnight Arsenal from any claims, damages, or expenses arising from your violation of these terms or your infringement of any third-party rights through uploaded content.
